These Terms & Conditions (“Terms”) govern your access to and use of AcostaSewers.com (the “Site”) and any related services provided by Acosta Sewers (“Acosta Sewers,” “we,” “our,” “us”). By using the Site, requesting an estimate, scheduling service, or otherwise engaging with us, you agree to these Terms.

1) Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to: (a) attempt to interfere with the Site’s operation, (b) scrape or harvest data, or (c) upload content that is unlawful, infringing, or harmful.

2) Estimates, Scheduling & Services

– Estimates: Any estimate (online, phone, or on-site) is a good-faith approximation based on available information and is not a guaranteed final price. Actual costs may vary due to site conditions, access, unforeseen issues, additional parts/labor, or regulatory requirements.
– Authorization: By scheduling service, you represent you are the owner or have authority to authorize work at the property and consent to access areas and shut-offs as needed.
– Change Orders: Material changes in scope may require revised estimates or additional authorization.
– Permits & Codes: Where required, we will follow applicable codes and obtain permits as agreed; permit fees and inspection scheduling may be billed separately if not otherwise specified.

3) Pricing, Invoicing & Payment

– Rates/Fees: Pricing may include trip charges, diagnostic fees, parts and materials, equipment use, and labor. Overtime/emergency rates may apply for off-hours or same-day services.
– Deposits: For certain jobs (e.g., large repairs, replacements, trenchless work), a deposit may be required prior to ordering materials or scheduling.
– Payment Terms: Payment is due as stated on the invoice (typically upon completion unless otherwise agreed). We may accept cards or digital payments via third-party processors. Late balances may accrue fees/interest as allowed by law.
– Non-Payment: We may suspend further work or withhold permits/close-out documents until balances are paid.

4) Cancellations, Access & Safety

– Cancellations/Rescheduling: Please provide reasonable notice. Fees may apply for last-minute cancellations, technician dispatch already in route, or inability to access the job site.
– Access & Safety: You agree to provide safe access to all work areas. We may refuse or stop work if unsafe conditions exist (e.g., hazardous materials, aggressive animals, structural instability).
– Utilities & Pre-Existing Conditions: We are not responsible for concealed or pre-existing conditions (e.g., corroded pipes, unknown utilities) that are revealed during work or that fail due to normal handling.

5) Limited Warranty

We stand behind our workmanship for a commercially reasonable period stated on your invoice or work order. Manufacturer warranties apply to products we supply and are subject to manufacturers’ terms. Exclusions: misuse, neglect, unauthorized alterations, customer-supplied parts, acts of God, and normal wear. Warranty service is limited to repair or re-performance of covered work; refunds are provided only as required by law.

6) No Emergency Reliance

Our Site is not an emergency service. If you have a water, gas, or sewer emergency, call 911 or your local utility before contacting us.

7) User Content & Reviews

If you submit reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing and operational purposes, subject to applicable law. Do not submit content you don’t have rights to share.

8) Intellectual Property

All content on the Site—including text, graphics, logos, and software—is owned by or licensed to Acosta Sewers and protected by law. You may not copy, distribute, or create derivative works without our prior written consent.

9) Third-Party Links & Instagram

The Site may link to third-party sites/services (including Instagram). Use of those sites is at your own risk and subject to the third party’s terms and policies. We are not responsible for third-party content or practices.

10) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SERVICE AVAILABILITY, PRICING, AND FEATURES MAY CHANGE WITHOUT NOTICE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACOSTA SEWERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/GOODWILL. OUR TOTAL LIABILITY RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SPECIFIC JOB GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT, OR $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITS; YOUR RIGHTS MAY VARY.

12) Indemnification

You agree to defend, indemnify, and hold harmless Acosta Sewers and its owners, employees, and contractors from any claims, damages, or costs (including reasonable attorneys’ fees) arising from: (a) your use of the Site; (b) your breach of these Terms; or (c) your negligence or misconduct related to services at your property.

13) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts principles. You agree to the exclusive jurisdiction of state and federal courts located in Los Angeles County, California. At our joint election, the parties may agree to submit disputes to binding arbitration administered by a reputable provider in Los Angeles County, on an individual (non-class) basis.

14) Changes to the Terms

We may update these Terms from time to time. The “Effective date” shows the latest version. Continued use of the Site after changes constitutes acceptance.

15) Severability & Waiver

If any provision is found unenforceable, the remaining Terms remain in effect. Our failure to enforce any right is not a waiver.
